ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
Within 28 days of the commencement of the licence (25 June 2008) the licensee shall:
Sound proof the rear fire door
Replace or soundproof the cooler at the rear of the Premises
Install a CCTV camera to monitor the entire area at the rear of the Premises
Alarm the inner fire door
Monitor the area at the rear of the Premises by camera and in person until patrons have gone home
As far as is within the control of the licensee keep the access to the area at the rear of the Premises clear
The Licensee and/or the Designated Premises Supervisor (DPS) shall be active members of the local Pub Watch Scheme, where one exists.
The DPS or a Personal Licence Holder shall always be on duty and in charge.
Staff shall be trained in the 4 licensing objectives and the terms of the Premises Licence.
Staff shall refuse to sell alcohol to customers who are intoxicated
A minimum of 2 door supervisors (licensed by the Security Industry Authority (SIA)) shall be on duty for the first 100 customers; increased by 1 door supervisor for each additional 100 customers or part thereof.
Between 2200 hrs and the closure of the Premises a minimum of 2 door supervisors shall always be at the front entrance to the Premises.
The Licensee, DPS, Manager or nominated representative shall monitor the area at the rear of the Premises by camera and in person until all patrons have gone home.
Door Supervisors shall:
Supervise the door and interior of the Premises
Make appropriate searches of customers for offensive weapons and drugs
Refuse admission to known troublemakers and intoxicated persons
Guard against outbreaks of damage and disorder
Make regular checks of the toilet areas for illegal activities
Prevent customers being admitted after 0230 hrs
Management and Door Supervisors shall interact through radio communications on all levels of the Premises.
A log book shall be maintained at the Premises and shall be available for inspection on demand by any Police Constable and authorised Officers of the Licensing Authority and the Security Industry Authority. The following details shall be recorded in the log book:
The name of each Door Supervisor
Their SIA licence number
The date, start time and finish time of their duty shift
Each entry shall be signed by the relevant Door Supervisor
All drinks shall be supplied in polycarbonate drinking vessels. Any drinks sold in bottles shall be decanted behind the bar into polycarbonate drinking vessels unless they are provided to the customer in plastic bottles.
A tamper resistant CCTV system shall be installed and (or alternately where such a system is already installed) shall be maintained in working order and operated at the Premises to the satisfaction of Lincolnshire Police and must be fit for purpose by complying with the following conditions:
The system shall be used to record during all hours that the Premises are open to the public
Where the recording is on a removable medium (i.e. videotape, compact disc, flash card etc,) a secure storage system to store those recording mediums shall be provided
The images recorded by the CCTV system shall be retained in unedited form for a period of not less than 28 days and must be endorsed with the accurate relevant time and date.
The system shall be capable of monitoring and recording satisfactory colour images from each and every camera continually e.g. Multiplex facility
The system must be capable of monitoring and recording entrances and exits, and any areas not easily observed by staff, including access to toilet facilities
CCTV shall be provided to cover the entire area at the rear of the Premises including the rear ground floor exit, the courtyard and the entrance gates
The recordings shall be provided to Officers of Lincolnshire Police on request
Officers of the Lincolnshire Police shall be permitted access to the system at any reasonable time
Signage shall be clearly displayed informing customers that a CCTV system is in operation and recording on the Premises
Customers shall not be permitted to bring alcoholic drinks into the Premises nor take them out of the Premises.
No drink shall be removed from the Premises in an unsealed container.
There shall be a written drugs policy for the Premises, formulated in conjunction with, and to the satisfaction of, Lincolnshire Police and the contents of said policy shall be appended to the current licence and shall be adhered to. Contravention of the policy contents will constitute a failure to comply with this condition and therefore a potential offence under Section 136 of the Licensing Act 2003 and/or Section 19 of the Criminal Justice and Police Act 2001.
Happy hours and shot races shall not be permitted.
Free drinking water shall be available from the bar at all times.
An adequate system shall be used to ensure that the number of persons on the Premises is known and the DPS or the person in charge shall if requested give that information to an authorised person.
The rear door shall be soundproofed.
Rear inner fire door shall be alarmed.
The cooler at the rear of the Premises shall be sound proofed or replaced.
As far as is within control of the licensee keep the access to the area at the rear of the Premises clear.
Fire Breathing and any other entertainment act or performance, with the potential to compromise public safety, will not be permitted in these Premises.
Refuse such as bottles shall be disposed of only at times when it is unlikely to cause a disturbance to residents in the vicinity of the Premises.
There shall be provided at the Premises containers for the storage and disposal of waste food and other refuse from the Premises. These containers shall be constructed, maintained and located so that access to them by vermin and unauthorised persons is prevented and arrangements shall be made for the regular lawful disposal of their contents.
The LAeq(5min) level measured 1 metre outside a window to a habitable room at any noise sensitive property, with regulated entertainment taking place at the Premises hereby licensed (“the Premises”), shall show no increase when compared with the representative LAeq(5min) level measured from the same position, under the same conditions and during a comparable period with no regulated entertainment taking place at the Premises.
The Leq(5min) levels in the 63Hz and 125Hz octave bands measured 1 metre outside a window to a habitable room at any noise sensitive property, with regulated entertainment taking place at the Premises hereby licensed (“the Premises”), shall show no increase when compared with the representative Leq(5min) level in the 63Hz and 125 Hz octave bands measured from the same position, under the same conditions and during a comparable period with no regulated entertainment taking place at the Premises.
The LAeq(5min) levels measured inside a habitable room of a noise sensitive property attached to the Premises hereby licensed (“the Premises”), with regulated entertainment taking place at the Premises, shall show no increase when compared with the representative LAeq(5min) levels measured from the same position, under the same conditions and during a comparable period with no regulated entertainment taking place at the Premises.
The Leq(5min) levels in the 63Hz and 125 Hz octave bands measured inside a habitable room of a noise sensitive property attached to the Premises hereby licensed (“the Premises”), with regulated entertainment taking place at the Premises, shall show no increase when compared with the representative Leq(5min) levels in the 63Hz and 125 Hz octave bands measured from the same position, under the same conditions and during a comparable period with no regulated entertainment taking place at the Premises.
There shall be a 30 minute wind-down period at the end of the permitted licensing hours which will include the lowering of music levels, the playing of appropriate calming music (live or recorded) and any other measures designed to create a calming and subduing atmosphere.
The rear ground floor emergency door must be kept closed at all times.
A notice shall be placed on the entrance gates to the rear courtyard stating ‘No access to (current Premises name) club.
No person under the age of 18 years shall be permitted on the Premises when they are being used for the licensed activities.
Persons who appear under the age of 21 shall only be allowed entry upon production of accredited proof of age.
