Additional Conditions

• ANNEX 1 - MANDATORY CONDITIONS

   

  1.              No supply of alcohol may be made under this licence:

   

  a)              at a time when there is no designated premises supervisor in respect of it, or

   

  b)              at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

   

   

    2.      Every retail sale or supply of alcohol made under this licence must be made or authorised by a person who holds a personal licence.

   

  Section 19 Licensing Act 2003

   

  3.              The admission of children under the age of 18 to film exhibitions permitted               under the terms of this licence shall be restricted in accordance with any               recommendations made

   

  a)              by the British Board of Film Classification (BBFC), where the film has been classified by that Board, or

   

  b)              by the Licensing Authority where no classification certificate has been granted by the BBFC, or, where the licensing authority has notified the licence holder that section 20(3)(b) of the Licensing Act 2003 applies to the film.

   

  Section 20 Licensing Act 2003

   

  4.              Only individuals licensed by the Security Industry Authority may be used at the premises to guard against:

   

  a)              unauthorised access or occupation (e.g. door supervision) or,

   

  b)              outbreaks of disorder, or

   

  c)              damage

   

  Section 21 Licensing Act 2003

   

• ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE

   

  A minimum number of 2 door staff registered with the Security Industry Authority will be on duty for the first 100 customers and thereafter 1 for every 100 customers or part thereof.

   

  Door staff will search customers for offensive weapons.  Management and door staff will interact through radio communication on all levels (foyer, reception, office and clubroom).

   

  A log book shall be maintained at the premises, in which shall be recorded the following details:-

   

  (i)     the door supervisor's name;

  (ii)    his/her Security Industry Authority licence number;

  (iii)   the time and date he/she starts and finishes duty;

  (iv)   each entry shall be signed by the door supervisor.

   

  That log book shall be available for inspection on demand by an Authorised Officer of the Council, the Security Industry Authority or a Police Constable.

   

  Membership of a local Pub Watch scheme (where one exists) is required and would include registration.

   

  No person in possession of a drink in a sealed or unsealed container shall be allowed to enter the premises except for the purposes of delivery.

   

  No drink shall be removed from the premises in an unsealed container.

   

  Only glasses which are made of ‘toughened glass’ will be used whether alcohol is being consumed on the premises or in any area outside the premises which trades as part of the premises.

   

  No Bottles are allowed in the foyer area. 

   

  No “Happy Hours” or “shot races” are permitted at the premises.

   

  Free drinking water shall be available at all times from the bar.

   

  At all times when the premises are used for the purpose of the licence, the licence holder, a club official, manager or designated premises supervisor who is responsible for the management of the premises shall at all times be aware of the number of persons on the premises and shall if requested to do so give that information to an authorised person.

   

   

  Refuse such as bottles shall be disposed of from the premises at a time when it is not likely to cause a disturbance to residents in the vicinity of the premises.

   

  There shall be provided at the premises containers for the storage and disposal of waste foods and other refuse from the premises.  Those containers shall be constructed, maintained and located so that access to them by vermin and unauthorised persons is prevented and arrangements shall be made for the regular lawful disposal of their contents.

   

  No person under the age of 18 years shall be permitted on the premises when they are being used for the purposes of the supply of alcohol and/or the provision of regulated entertainment.

   

  Bar staff and door supervisors will be required to strictly and at all times;

   

  Refuse admission to known troublemakers and intoxicated persons.

  Refuse to sell alcohol to those who are already intoxicated.

   

  A zero tolerance policy on drugs will be implemented

   

  Weekly manual searches of customers and staff will always be carried out.

   

  Drugs found on customers or staff will be seized immediately and handed to the police.  All such incidents, if any, will be recorded and a “drugs box” provided.

   

  A sterile area for drug searches and for detaining persons found with drugs until police arrive will be provided.

   

  Staff will be required to inform the police immediately of someone taking or handling drugs, or someone under the influence of drugs on the premises.

   

  Staff will regularly check toilets for drugs.

   

  Staff will undergo regular training in order to be able to recognise different types of drugs and behaviour of persons under the influence of drugs.

   

  Persons under the influence of drugs will always be refused entry and any such incident immediately recorded and reported.

   

  A “chill out” area will be provided.

   

   

• ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY

   

  There shall be no admittance to the premises after 02.30a.m.

   

  A CCTV system shall be installed on the premises.

   

  The system and equipment installed must be approved by the Lincolnshire Police following completion of a survey by a qualified Crime Reduction Officer.

   

  The system must operate during the whole time the premises are open to the public.  Leaving the equipment in operation during non-opening hours is also a good crime reduction initiative in the event of a burglary occurring.

   

  The system must include a thirty-one day video library.

   

  Each tape must be endorsed with times and dates of recordings and shall be retained not less than 28 days before re-use.

   

  The system must be capable of recording a satisfactory image from each and every camera continually e.g. multiplex.

   

  The system must be capable of monitoring and recording entrances and exists, and any areas not easily observed by staff, including toilet areas.

   

  The Licensee shall allow officers of the Lincolnshire Police/Local Authority access to the system at any time when the premises are open or at any other reasonable time.

   

  The Licensee shall provide such tapes as requested by an officer of the Lincolnshire Police/Local Authority.

   

  CCTV shall be provided to cover the rear ground floor fire exit, the courtyard and the entrance gates.

   

  At all times at least two Door Supervisors or accredited Security Industry Authority Managers shall be in the front of the premises from 10pm until the closure of the premises.

   

  All door Supervisors must be licensed by the Security Industry Authority.

   

  A notice shall be placed on the entrance gates to the rear courtyard stating “No access to Havana Club”.

   

  To prevent noise and disturbance at nearby residential properties.

   

  (a)              The LAeq(5min) level measured 1 metre outside a window to a habitable room at any noise sensitive property, with regulated entertainment taking place at the premises hereby licensed (“the premises”), shall show no increase when compared with the representative LAeq(5min)  level measured from the same position, under the same conditions and during a comparable period with no regulated entertainment taking place at the premises.

   

  (b)              The Leq(5min) levels in the 63Hz and 125Hz octave bands measured 1 metre outside a window to a habitable room at any noise sensitive property, with regulated entertainment taking place at the premises hereby licensed (“the premises”), shall show no increase when compared with the representative Leq(5min)  level in the 63Hz and 125 Hz octave bands measured from the same position, under the same conditions and during a comparable period with no regulated entertainment taking place at the premises.

   

  (c)              The LAeq(5min) levels measured inside a habitable room of a noise sensitive property attached to the premises hereby licensed (“the premises”), with regulated entertainment taking place at the premises, shall show no increase when compared with the representative LAeq(5min) levels measured from the same position, under the same conditions and during a comparable period with no regulated entertainment taking place at the premises.

   

  (d)              The Leq(5min) levels in the 63Hz and 125 Hz octave bands measured inside a habitable room of a noise sensitive property attached to the premises hereby licensed (“the premises”), with regulated entertainment taking place at the premises, shall show no increase when compared with the representative Leq(5min) levels in the 63Hz and 125 Hz octave bands measured from the same position, under the same conditions and during a comparable period with no regulated entertainment taking place at the premises.

   

  (e)              The rear ground floor emergency door must be kept closed at all times.
