ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
1. The premises will operate as a restaurant where the sale and supply of alcohol is not the primary or exclusive use for those premises and alcohol is sold as ancillary to/after a substantial meal or sold as ancillary in a sealed container with a takeaway meal either collected or delivered.
2. No persons or customers will be admitted after 0100hours on any day (where a customer is any person resorting to those premises for the purpose of a licensable activity) save for re-admittance for existing customers who have retired outside the premises to enable them to smoke.
For the purposes of a function being held at the premises:
(a function is defined as operation of the premises other than in accordance with condition 1)
· There shall be provided at the premises door supervisors to such a number, if any, as the management of the premises consider are sufficient to control the entry of persons to the premises and for the keeping of order in the premises.
· A record/log book shall be kept on the premises by the Designated Premises Supervisor of every person employed on the premises as a door supervisor.
· The record shall contain the following details:-
1. The door supervisor's name;
2. His/Her Security Industry Authority Licence Number
3. The time and date he/she commenced and concluded their duty
4. The door supervisors shall sign each entry
5. The Designated Premises Supervisor or other authorised person shall also endorse each entry as having checked the authenticity of the individual door supervisor.
· That record shall be available for inspection on demand by an Authorised Officer of the Council, the Security Industry Authority or a Police Constable.
· Each entry shall be retained for a period of 24 months from date of completion.
· Door supervisors shall remain outside the premises until at least after the close of business.
· On the occasion of any function at the premises specifically for teenage persons and where at least 40 of those persons attending will be teenagers, the premises will ALSO operate the following;
a) The function will be notified to Lincolnshire Police Licensing Office, West Parade, Lincoln, LN1 1YP, giving at least 10 police working days notice of the event.
b) Admittance shall be by means of invitation only, a copy of the invitation and guest list must be forwarded to the Designated Premises Supervisor prior to the event, and access will only be granted on production of said invitation.
3. A tamper resistant CCTV system shall be installed, maintained in working order and operated at the premises and must be ’Fit for Purpose ‘ by complying with the following conditions:
a. The system shall be used to record colour images to assist in the identification of individuals during all hours that the premises are open to the public.
b. Where the recording is on a removable medium (i.e. videotape, compact disc, flash card etc.), a secure storage system to store those recording mediums shall be provided.
c. The images recorded by the CCTV system shall be retained in unedited form for a period of not less than 14 days.
d. All CCTV recordings must be made available to Lincolnshire Police on request.
e. Signage shall be clearly displayed informing customers that a CCTV system is in operation and recording on the premises.
4. A proof of age policy is to be applied with the accepted means of proof of age being:
a. A recognised proof of age card accredited under the British Retail Consortiums Proof of Age Standards Scheme (PASS)
b. Photocard driving licence
c. Passport
d. Any future accredited and accepted proof of age as defined by Lincolnshire Police.
