ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
1. Credit Sales
Alcohol shall not be sold or supplied unless it is paid for before or at the time when it is sold or supplied, except alcohol sold or supplied:
a) with and for consumption at a meal supplied at the same time, consumed with the meal and paid for together with the meal;
b) for consumption by a person residing in the premises or his guest and paid for together with his accommodation;
c) to a canteen or mess.
2. Children in Bar (No Children’s Certificate)
No person under fourteen shall be in the bar of the licensed premises during the permitted hours unless one of the following applies:
a) He is the child of the holder of the premises licence.
b) He resides in the premises, but is not employed there.
c) He is in the bar solely for the purpose of passing to or from some part of the premises which is not a bar and to or from which there is no other convenient means of access or egress.
d) The bar is in railway refreshment rooms or other premises constructed, fitted and intended to be used bona fide for any purpose to which the holding of the licence is ancillary.
In this condition “bar” includes any place exclusively or mainly used for the consumption of alcohol. But an area is not a bar when it is usual for it to be, and it is, set apart for the service of table meals and alcohol is only sold or supplied to persons as an ancillary to their table meals.
3. Door Supervisors
There shall be provided at the premises door supervisors to such a number as the management of the premises consider are sufficient to control the entry of persons to the premises and for the keeping of order in the premises when they are used for the provision of a licensable activity.
A record/log book shall be kept on the premises by the Designated Premises Supervisor of every person employed on the premises as a door supervisor. The record shall contain the following details:-
a) The door supervisors name
b) His/Her Security Industry Authority (SIA) Licence Number
c) The time and date he/she commenced and concluded their duty.
d) The door supervisors shall sign each entry
e) The Designated Premises Supervisor or other authorized person shall also endorse each entry as having checked the authenticity of the individual door supervisor.
The record shall be available for inspection on demand by an Authorised Officer of the Council, the Security Industry Authority or a Police Constable.
Each entry shall be retained for a period of 24 months from the date of completion.
Each door supervisors licence number will be verified by the Designated Premises Supervisor or their agent using the Internet SIA website, on the occasion of each door supervisor’s initial employment at the premises. Thereafter a weekly check shall be carried out to ensure the licence status remains unchanged.
This verification check will be recorded and signed appropriately by the Designated Premises Supervisor or their agent.
4. Protection of Children.
There shall be in place for the premises a written policy to prevent the sale or supply of alcohol to persons under 18 years of age. That policy shall require any person who appears to be under the age of 18 years to produce one of the following forms of identification:
a) A recognized proof of age card accredited under the British Retail Consortiums Proof of Age standards Scheme (PASS).
b) Photo driving licence
c) Passport
d) Any other means of identification approved and accredited in writing by Lincoln Police Licensing Office.
All point of sale staff shall undergo training in the above policy with a record kept of the date of training, signed by the member of staff and the trainer.
Each entry shall be retained for a period of 24 months from the date of completion.
This record shall be made available for inspection by Lincolnshire Police Officers or other parties acting on their behalf.
Notices shall be displayed at the entrances to the premises in positions where they can be seen and read clearly and shall indicate that it is unlawful for a person under 18 years of age to purchase alcohol, and that it is unlawful for any person to purchase alcohol on behalf of any person under 18 years of age.
Children under the age of 16 years of age shall only be admitted on the premises providing they are accompanied by responsible adults.
All children under the age of 14 years shall have vacated the premises by 11pm unless attending a pre-booked function.
