ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
There shall be no sales of alcohol between the hours of midnight and 5am daily.
There shall be no Late Night Refreshment (sales of hot food and/or hot drinks) between the hours of Midnight and 5am daily.
A CCTV system shall be installed and (or alternatively where such a system is already installed) shall be maintained in working order and operated at the premises to the satisfaction of Lincolnshire Police i.e. 'Fit for purpose' by complying with the following conditions:
A colour monitor shall be provided for the viewing of live or recorded images and together with the recording equipment, shall be securely located, in order to prevent unauthorised access, tampering or removal of images.
The system shall have a removable recording medium (separate from the system hard drive), for which secure storage shall be provided.
The system shall be used to record during all hours that the premises are open to the public.
The images recorded by the CCTV system shall be retained in unedited form for a period of not less than 28 days and must be endorsed with the accurate relevant date and time.
The system shall record a minimum of 12 frames per second. The quality of the images shall not be compromised to allow more to be squeezed onto the system.
To ensure continued quality of recording, regular maintenance of all aspects of the system shall be conducted - especially camera focus and cleaning of lenses and housings.
If at all possible, without causing detriment to the efficacy of the practical operation of the system, cameras shall be sited/constructed so as to reduce the risk of tampering/unauthorised interference.
The system should be able to quickly export video and stills to a removable storage system. Following export, the images shall be capable of being played on a DVD or PC without any additional software.
The system shall be capable of monitoring and recording satisfactory images from each and every camera continually e.g Multiplex facility. Where adequate lighting permits, images will be recorded in colour. In areas of subdued lighting black and white images will be recorded in order to maximise image quality. The system shall be capable of monitoring and recording entrances and exits, and any areas not easily observed by staff, including access to toilet facilities.
Any outside area used for the consumption of alcohol shall be fully covered by CCTV.
The recordings shall be provided to officers of Lincolnshire Police immediately on request if practicable, but in any case within 3 days of said request.
Officers of the Lincolnshire Police shall be permitted access to the system at any reasonable time.
During all hours that the premises are open or licensable activites are permitted, a member of staff will at times be on the premises and capable of operating the system in its entirety.
1. The permitted times do not prohibit:
a) during the first twenty minutes after the above hours, the taking of the alcohol from the premises, unless the alcohol is supplied or taken in an open vessel;
b) the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered;
c) the sale of alcohol to a trader or club for the purposes of the trade or club;
d) the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces;
2. Alcohol shall not be sold in an open container or be consumed on the licensed premises.
3. Credit Sales
Alcohol shall not be sold or supplied unless it is paid for before or at the time when it is sold or supplied, except alcohol sold or supplied to a canteen or mess.
