Additional Conditions

• ANNEX 1 - MANDATORY CONDITIONS

   

  1.              No supply of alcohol may be made under this licence:

   

  a)  at a time when there is no designated premises supervisor in respect of it, or

   

  b)  at a time when the designated premises supervisor does not hold a personal licence,

      or his personal licence is suspended.

   

  2.              Every retail sale or supply of alcohol made under this licence must be made or authorised by a person who holds a personal licence

   

  3.              The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.

   

  In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children-

   

  (a)              games or other activities which require or encourage, or are designed to require or encourage, individuals to-

   

  (i)              drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or

   

  (ii)              drink as much alcohol as possible (whether within a time limit or otherwise);

   

  (b)              provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act);

   

  (c)              provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less;

   

  (d)              provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on-

   

  (i)              the outcome of a race, competition or other event or process, or

   

  (ii)              the likelihood of anything occurring or not occurring;

   

  (e)              selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner.

   

  4.              The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).

   

  5.              The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.

   

  6.              The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.

   

  The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.

   

  7.              The responsible person shall ensure that-

   

  (a)              where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-

   

  (i)              beer or cider: ½ pint;

   

  (ii)              gin, rum, vodka or whisky: 25 ml or 35 ml; and

   

  (iii)              still wine in a glass: 125 ml; and

   

  (b)              customers are made aware of the availability of these measures.

   

  Section 19 Licensing Act 2003 (as amended)

   

  The admission of children under the age of 18 to film exhibitions permitted under the terms of this licence shall be restricted in accordance with any recommendations made:

   

  a)              by the British Board of Film Classification (BBFC), where the film has been classified by that Board, or

   

  b)              by the Licensing Authority where no classification certificate has been granted by the BBFC, or, where the licensing authority has notified the licence holder that section 20(3)(b) of the Licensing Act 2003 applies to the film.

   

  Section 20 Licensing Act 2003

   

  Only individuals licensed by the Security Industry Authority may be used at the premises to guard against:

   

  a)  unauthorised access or occupation (e.g. door supervision) or,

  b)  outbreaks of disorder, or

  c)  damage

   

  Section 21 Licensing Act 2003

   

   

• ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE

   

  Protection of Children

   

  There shall be in place for the premises a policy to prevent the sale or supply of alcohol to persons under 18 years of age.  That policy shall require any person who appears to be under the age of 18 years to produce one of the following forms of identification:

   

  A recognised proof of age card accredited under the British

  Retail  Consortiums Proof of Age Standards Scheme (PASS),

  Photocard driving licence,

  Passport,

  Any other means approved by Lincoln Police Licensing Office.

   

  All bar staff shall undergo training in the above-mentioned policy with a record kept of the date of training, signed by the member of staff and the trainer.

   

  This record shall be retained for 2 years from date of completion and made available to Lincolnshire Police or their authorised agents upon request.

   

  A notice or notices shall be displayed in and at the entrance to the premises where they can be clearly seen and read and shall indicate;

   

  1.              That it is unlawful for persons under 18 to purchase alcohol or for any person to purchase alcohol on behalf of a person under 18 years of age.

   

  2.              That proof of age may be requested at the premises The accepted means for proof of age will be listed on the notice(s)

   

  Children shall be excluded from any function which includes nudity/partial nudity or adult humour.

   

  There shall be a robust child protection policy based on the Child Protection Document produced by Lincolnshire Safeguarding Children Board.

   

  All children up to and including the age of 16 must be accompanied by an adult.

   

  Adult Entertainment

   

  Only ‘Approved adult entertainment’ shall be permitted at the premises.

   

  There shall be no adult entertainment before 9pm, the premises shall be cleared of children before the entertainment starts.

   

  ‘Approved adult entertainment’ shall describe entertainment consisting of striptease, wearing of see through material or other performance or entertainment involving nudity.

   

  No still or moving photographic or video recordings other than by CCTV monitoring equipment installed for crime prevention purposes shall be made of any performance of ‘approved adult entertainment’.

   

  There shall be no images of nakedness, nudity or of any description of a sexually explicit nature to cause offence as to the nature of the entertainment being held on the premises on any external advertising.

   

  Performances of an Approved adult entertainment shall not be the subject of any advertising involving the distribution of leaflets, promotion by canvassers or by touting in the street.

   

  The approved adult entertainment shall not be visible from the street.

   

  Any person who can be observed from outside the premises shall be  decently dressed.

   

  No person either resident, staff, performer, entertainer, visitor or customer under the age of 18 years shall be allowed in any part of the premises whilst an approved adult entertainment is being performed or at any time whilst a rehearsal or audition for such entertainment is being conducted.

   

  A clear notice shall be displayed at each entrance to the premises, in a prominent position so that it can easily be read by people entering the premises, saying:

   

  NO PERSONS UNDER THE AGE OF 18 YEARS SHALL BE ADMITTED

   

  The approved adult entertainment shall be given only by   performers/entertainers who are engaged exclusively for that purpose.

   

  No performer shall be allowed to work if they appear to be under the   influence of intoxicating liquor and/or drugs.

   

  The approved entertainment shall be restricted to dancing and the removal of clothes, there shall not be any other form of sexual activity.

   

  There shall be no physical participation between any member of the  audience and any other performer.

   

  The Licensee, management or anyone concerned in providing the    approved adult entertainment shall not encourage or permit the encouragement of the audience to throw money or otherwise gratuities to the performers.

   

  No performer shall accept or give any telephone number or business card   or note to or from members of the audience.

   

  Performers shall be provided with changing room(s) which shall be located so as to be separate and apart from public facilities.

   

  No person other than performers and authorised staff shall be permitted in the changing room(s).

   

  On arrival each customer shall be provided with a copy of the House Rules, which shall include conditions l) to q) inclusive.

   

  Each performer shall be provided with a copy of these conditions a) to s) inclusive.

   

  CCTV Systems

   

  A tamper resistant CCTV system shall be installed, maintained in working  order and operated at the premises and must be ’Fit for Purpose ‘ by complying with the following conditions:

   

             The system shall be used to record during all hours that the premises are  open to the public.

   

             Where the recording is on a removable medium (i.e. videotape, compact disc, flash card etc.), a secure storage system to store those recording mediums shall be provided.

   

  The images recorded by the CCTV system shall be retained in unedited form for a period of not less than 28 days and must be endorsed with the accurate relevant time and date.

   

  The system shall be capable of monitoring and recording satisfactory colour images from each and every camera continually e.g. Multiplex facility.

   

  The system must be capable of monitoring and recording entrances and exits, and any areas not easily observed by staff, including access areas to toilet facilities.

   

  Any outside area used for the consumption of alcohol shall be fully covered by a CCTV to the satisfaction of Lincolnshire Police.

   

  The recordings shall be provided to officers of Lincolnshire Police on request.

   

  Officers of the Lincolnshire Police/Local Licensing Authority shall be permitted access to the system at any reasonable time.

   

  Signage shall be clearly displayed informing customers that a CCTV system is in operation and recording on the premises.

   

  There shall be provided at the premises door supervisors to such a number as the management of the premises consider are sufficient to control the entry of persons to the premises and for the keeping of order in the premises when they are used for the provision of a licensable activity.

   

  A record/log book shall be kept on the premises by the Designated Premises Supervisor of every person employed on the premises as a door supervisor.

   

  The record shall contain the following details:-

   

  The door supervisor's name;

  His/Her Security Industry Authority Licence Number,

  The time and date he/she commenced and concluded their duty,

  The door supervisors shall sign each entry.

   

  The Designated Premises Supervisor or other authorised person shall    also endorse each entry as having checked the authenticity of the individual door supervisor.

   

  That record shall be available for inspection on demand by an Authorised Officer of the Council, the Security Industry Authority or a Police Constable.

   

  Each entry shall be retained for a period of 24 months from date of completion.

   

  Door supervisors remain outside the premises until at least after the last customer has left the premises.

   

  Each Door supervisors licence number will be verified by the DPS or their agent using the Internet SIA website, on each occasion of the door supervisors employment at the premises.

   

  This verification check will be recorded and signed appropriately by the DPS or their agent.

   

  On the occasion of any function at the premises specifically for teenage persons or where the majority of those persons attending will be teenagers, the premises will operate the following:

   

  At least 2 SIA registered door supervisors will be provided at the premises to control the entry of persons to the premises and for the keeping of order in the premises and will remain thus employed until the last customer has left.

   

  The function will be notified to Lincolnshire Police Licensing Office, West Parade, Lincoln, LN1 1YP, giving at least 10 police working days notice of the event.

   

  Admittance shall be by means of invitation only, a copy of which must be forwarded to the Designated Premises Supervisor prior to the event, and invitations produced on the night to ensure access to the event.

   

  During the course of the event, a responsible parental presence will be required and should be identified to the DPS/Manager/Person in charge of the venue

   

  Fire Safety

   

  A detailed plan of the relevant fire precautions, means of escape and fire risk assessment for the marquee shall be provided before its erection on each separate occasion.

   

  Miscellaneous

   

  Membership of a local pub watch scheme (when one exists) is required and would include registration.
