ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
There shall be in place for the premises a written policy to prevent the sale or supply of alcohol to persons under 18 years of age. That policy shall require any persons who appear to be under the age of 18 years to produce one of the following forms of identification:
A recognised proof of age card accredited under the British Retail Consortiums Proof of Age Standards Scheme (PASS).
Photo Driving Licence
Passport
Any other means of identification approved and accredited in writing by Lincoln Police Licensing Office.
All point of sale staff shall undergo training in the above policy with a record kept of the date of training, signed by the member of staff and the trainer.
Each entry shall be retained for a period of 24 months from the date of completion.
This record shall be made available for inspection by Lincolnshire Police Officers or other parties acting on their behalf.
A notice or notices shall be displayed in and at the entrance to the premises where they can be clearly seen and read and shall indicate:
That it is unlawful for persons under 18 to purchase alcohol or for any person to purchase alcohol on behalf of a person under 18 years of age.
That proof of age may be requested at the above premises and those accepted means for proof of age are as listed.
No person in possession of an alcoholic drink in a sealed or unsealed container shall be allowed to enter the premises except for the purposes of delivery.
There shall be provided at the Premises, door supervisors to such a number as the management of the premises considers are sufficient to control the entry of the persons to the Premises, and for the keeping of order in the Premises when they are used for the provision of a licensable activity.
A record/log book shall be kept on the Premises by the licence holder of every person employed as a door supervisor.
The record shall contain the following details:
The door supervisors name.
His/her Security Industry Authority Licence number.
The time & date he/she commenced and concluded their duty.
The door supervisors shall sign each entry.
The Premises Licence Holder or other authorised person shall also endorse each entry as having checked the authenticity of the individual door supervisor.
That record shall be available for inspection, on demand, by an Authorised Officer of the Council, the Security Industry Authority or a Police Constable.
Each entry shall be retained for a period of 24 months from the date of completion.
Each door supervisors licence number will be verified by the Premises Licence Holder using the Internet SIA Website, on the occasion of each door supervisors initial employment at the Premises, and thereafter on each occasion that the door supervisors are used.
The verification check will be recorded and signed by the Premises Licence Holder or their agent.
The Premises Licence Holder or their agent will carry out regular assessments of any noise emanating from the Premises.
The Centre shall limit the amount of major events, selling alcohol, to no more than 15 events per year.
The maximum numbers of persons, including staff or performers, allowed in these Premises shall be determined and the maximum numbers determined will not be exceeded. There shall be an effective system for determining and recording the number of persons on the Premises at any one time when licensable activity is occurring.
The Permitted times do not prohibit:
During the first twenty minutes after the above hours the consumption of alcohol on the Premises.
During the first twenty minutes after the above hours, the taking of alcohol from the Premises unless the alcohol is supplied or taken in an open vessel.
During the first thirty minutes after the above hours the consumption of the alcohol on the Premises by persons taking meals there if the alcohol was supplied for consumption as ancillary to the meals.
Consumption of the alcohol on the Premises or the taking of sale or supply of alcohol to any person residing in the licensed Premises.
The ordering of alcohol to be consumed off the Premises, or the despatch by the vendor of the alcohol so ordered;
The sale of alcohol to a trader or club for the purposes of the trade or club.
The sale or suply of any alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised Mess of members of Her Majesty's naval, military or air forces.
The taking of alcohol from the Premises by a person residing there; or
The suply of alcohol for consumption on the Premises to any private friends of a person residing there who are bona fide entertained by him at his own expense, or the consumption of alcohol by persons so supplied; or
The supply of alcohol for consumption on the Premises to persons employed there for the purposes of the business carried on by the holder of the licence, or the consumption of alcohol so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.
Alcohol shall not be sold or supplied unless it is paid for before or at the time when it is sold or supplied, except alcohol sold or supplied:
With and for consumption at a meal at the same time, consumed with the meal and paid for together with the meal.
For consumptionby a person residing in the Premises or his guest and paid for together with his accommodation;
To a canteen or mess.
No person under fourteen shall be in the bar of the licensed Premises during the permitted hours unless one of the following applies:
He is the child of the holder of the Premises Licence.
He resides in the Premises, but is not employed there.
He is in the bar solely for the purpose of passing to or from some part of the Premises which is not a bar and to or from which there is no other convenient means of access or egress.
The bar is in railway refreshment rooms or other Premises constructed, fitted and intended to be used bona fide for any purpose to which the holding of the licence is ancillary.
In this condition "bar" includes any place exclusively or mainly used for the consumption of alcohol. But an area is not a bar when it is usual for it to be, and it is, set apart for the service of table meals and alcohol is only sold or supplied to persons as an ancillary to their table meals.
