ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY
A CCTV system shall be installed and (or alternately where such a system is already installed) shall be maintained in working order and operated at the premises to the reasonable satisfaction of Lincolnshire Police and must be “Fit for Purpose” by complying with the following conditions:
The system shall be used to record during all hours that the premises are open to the public.
The images recorded by the CCTV system shall be retained in unedited form for a period not less than 28 days and must be endorsed with the accurate relevant time and date.
The system shall be capable of monitoring and recording satisfactory colour images from each and every camera continually e.g. Multiplex facility.
The system must be capable of monitoring and recording entrances and exits, and any areas not easily observed by staff, including access areas to toilet areas.
The recordings shall be provided to officers of Lincolnshire Police on request.
Officers of the Lincolnshire Police shall be permitted access to the system at any reasonable time.
During all hours that the premises are open or licensable activities are permitted, a member of staff trained to operate the CCTV system will at all times be on the premises.
There shall be provided at the premises door supervisors to such a number as the management of the premises consider are sufficient to control the entry of persons to the premises and for the keeping of order in the premises when they are used for the provision of a licensable activity.
A record/log book shall be kept on the premises by the Designated Premises Supervisor of every person employed on the premises as a door supervisor.
The record shall contain the following details:
a) The door supervisor’s name;
b) His/Her Security Industry Authority Licence Number;
c) The time and date he/she commenced and concluded their duty;
d) The door supervisors shall sign each entry;
e) The Designated Premises Supervisor or other authorised person shall also endorse each entry as having checked the authenticity of the individual door supervisor.
That record shall be available for inspection on demand by an Authorised Officer of the Council, the Security Industry Authority or a Lincolnshire Police Officer.
Each entry shall be retained for a period of 24 months from date of completion.
Door supervisors to ensure that no customer leaves with any bottles or glasses.
Door supervisors to control the queue to the premises to ensure that customers are advised of the amount of time they are going to wait to gain entry and to prevent any customers who have behaved in such a way as to cause a public nuisance or disturbance from entering the premises.
Each door supervisor’s licence number will be verified by the DPS or their agent using the Internet SIA website, on the occasion of each door supervisor’s initial employment at the premises. Thereafter a weekly check shall be carried out to ensure the licence status remains unchanged.
This verification check will be recorded and signed appropriately by the DPS or their agent.
There shall be an effective system for determining and recording the number of persons in the premises at any one time when licensable activity is occurring on the premises.
A method of communicating between the local police and other licensed premises by way of radio links shall be provided at the premises and shall be switched on and available during the opening hours of the premises.
Any radio link provided for communication with the local police and other licensed premises shall be kept in good working order at all times.
Every incident of crime or disorder in the premises shall be reported via the radio link to an agreed police contact point by the Designated Premises Supervisor or a nominated member of staff.
A bound and sequentially paginated incident book shall be kept on the premises by the Designated Premises Supervisor recording every incident of crime and disorder involving the premises, staff, customers or door supervisors.
The Incident Book shall contain the following details:
Time, date and location of incident;
Nature of the incident;
Names, addresses and contact details of persons involved;
Result of the incident;
Action taken to prevent further such incidents;
Each entry signed by the Designated Premises Supervisor or other responsible person employed at the premises and so authorised by the Designated Premises Supervisor.
The Incident Book shall be made available on demand for Local Licensing Officers or Lincolnshire Police Officers.
Each Incident Book shall be retained for a period of 24 months.
There shall be in place for the premises a written policy to prevent the sale or supply of alcohol to persons under 18 years of age.
All point of sale staff shall undergo training in the above-mentioned written policy with a record kept of the date of training, signed by the member of staff and the trainer.
Each entry shall be retained for a period of 24 months from date of completion.
This record shall be made available for inspection by Lincolnshire Police Officers or other parties acting on their behalf.
A notice or notices shall be displayed in and at the entrance to the premises where they can be clearly seen and read and shall indicate:
a) That it is unlawful for persons under 18 years of age to purchase alcohol or for any person to purchase alcohol on behalf of a person under 18 years of age.
b) That proof of age may be requested at the premises.
A refusal register shall be maintained on the premises in the following format:
a) The Register shall be in bound pages format with each page consecutively numbered.
b) Each entry shall be timed, dated and signed by the staff member making the refusal.
c) Description or name of refused person to be recorded.
d) Each entry to be dated and signed by the Designated Premises Supervisor and/or Manager/Supervisor.
e) The item attempted to purchase.
f) Reason for refusal.
g) The Register shall be retained for a period of 24 months.
h) The Register to be produced on request from a Lincolnshire Police Officer, Trading Standards or the Local Licensing Authority.
No form of approved adult entertainment shall take place on the premises. (Approved adult entertainment is accepted as including striptease, nudity, the wearing of see through material, lap dancing, table dancing and pole dancing and entertainment of a similar nature and includes any such activity displayed on a screen or forming part of another licensable activity).
There shall be a written drugs policy for the premises, formulated in conjunction with, and to the satisfaction of Lincolnshire Police and the contents of said policy shall be appended to the current licence and shall be adhered to. Contravention of the policy contents will constitute a failure to comply with this condition and therefore a potential offence under Section 136 of the Licensing Act 2003 and/or Section 19 of the Criminal Justice and Police Act 2001.
All staff will be trained in respect of this policy.
A written record shall be kept detailing the following;
a) Name of the member of staff
b) Name of the Trainer
c) Date the Training was completed
d) Staff member and trainer to sign the authenticity of the record.
e) Each entry shall be retained for a period of 24 months from date of completion.
There shall be remedial or refresher training at a time deemed appropriate by the Designated Premises Supervisor.
The Licensed premise and any persons employed in its operation as a licensed premise, shall be subject to such testing or screening for illegal substances as requested by Lincolnshire Police Officers or their authorised agents.
Notices will be displayed advising customers that searches will be carried out and admission will be refused to customers refusing to be searched. A record shall be kept showing details of anyone refusing to be searched, together with the time and date of the refusal. Such record to be made available for inspection and copying by police upon request.
If drugs are found during a personal search, or whilst being used within the premises, a clear image of the person found in possession will be captured on CCTV. Following a risk assessment of the situation arising from the find, any person found using or in possession of drugs will be detained, if safe and practicable, and the police called.
Any drugs or weapons found; either during a search or otherwise on the premises, will be confiscated and stored in a secure container (drug amnesty box) prior to being handed over to the police, which must be done as soon as practicable.
Any seizures of drugs, weapons, or other property shall be recorded, together with the name and address of the person found with the article. The record shall be made in a diary or bound book, which shall be retained at the premises for at least two years, and shall be made available for inspection and copying by the police upon request.
A bound and sequentially numbered incident book shall be kept to record all instances of disorder, damage and personal injury at the premises. The book to be made available for inspection and copying by the police and other officers of Responsible Authorities upon request, and all such books to be retained at the premises for at least two years.
The toilets at the premises to be checked hourly for drugs use and evidence of supply taking place. A record to be kept of the results of the checks, detailing how and where any illegal substance was found. The record to be retained at the premises and made available for inspection and copying by the police upon request.
The Drug Amnesty Box shall be a strong metal box, which is lockable and securely attached to the floor or wall inside the premises within easy reach of the main entrance to facilitate ease of depositing items within.
The Drug Amnesty Box will be constructed so that items may be placed within, without any person coming into contact with the contents of the box.
Any article found within the premises or immediately outside and suspected of being a controlled drug or other dangerous article should be placed in the Drug Amnesty Box or if impracticable, immediately handed to police.
The Drug Amnesty Box will be opened and emptied, in conjunction with the police, upon police request with reasonable notice given.
The Drug Amnesty Box will have two locks, one deemed the Management Lock and the other the Police Lock, the two locks and keys to differ.
Customers entering the premises will be directed to place any items in the Drug Amnesty Box they wish to, prior to being in any area where they could be subjected to a search.
