ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY
There shall be no admittance to the premises after 12.30am
A tamper resistant CCTV system shall be installed, maintained in working order and operated at the premises and must be “Fit for Purpose” by complying with the following conditions:
1. The system shall be used to record during all hours that the premises are open to the public.
2. Where the recording is on a removable medium (i.e. videotape, compact disc, flash card etc.), a secure storage system to store those recording mediums shall be provided.
3. The images recorded by the CCTV system shall be colour images, to make identification easier, retained in unedited form for a period of not less than 28 days and must be endorsed with the accurate relevant time and date.
4. The system shall be capable of monitoring and recording satisfactory colour images from each and every camera continually e.g. Multiplex facility.
5. The system must be capable of monitoring and recording entrances and exits, and any areas not easily observed by staff, including toilet areas, and in respect of these premises the area giving foot access from Southgate to the premises. This area should also be adequately lit to enhance the CCTV images.
6. Any outside area used for the consumption of alcohol shall be fully covered by a CCTV to the satisfaction of Lincolnshire Police.
7. The recordings shall be provided to officers of Lincolnshire Police/Local Licensing Authority on request.
8. Officers of the Lincolnshire Police/Local Licensing Authority shall be permitted access to the system at any reasonable time.
9. All CCTV recordings must be made available to Lincolnshire Police on request.
10. Signage shall be clearly displayed informing customers that a CCTV system is in operation and recording on the premises.
There shall be provided at the premises door supervisors to such a number as the management of the premises consider are sufficient to control the entry of persons to the premises and for the keeping of order in the premises when they are used for the provision of regulated entertainment/a licensable activity.
A record/log book shall be kept on the premises by the Designated Premises Supervisor of every person employed on the premises as a door supervisor. The record shall contain the following details: -
(i) The door supervisor's name.
(ii) His/Her Security Industry Authority Licence Number.
(iii) The time and date he/she commenced and concluded their duty.
(iv) The door supervisors shall sign each entry.
(v) The Designated Premises Supervisor shall verify each entry as correct.
The record/log book shall be available for inspection on demand by an Authorised Officer of the Council, the Security Industry Authority or a Police Constable.
A method of communicating between the local police and other licensed premises by way of text / pager or radio links shall be provided at the premises.
Any text /pager or radio link provided for communication with the local police and other licensed premises shall be kept in good working order at all times.
When the premises are open to the public, the communications link to the local police or other licensed premises shall be switched on and available to and monitored by the Designated Premises Supervisor or a nominated member of staff.
Every incident of crime or disorder in the premises shall be reported via the text / pager or radio link to an agreed police contact point by the Designated Premises Supervisor or a nominated member of staff.
The Designated Premises Supervisor, when present, and all members of staff shall ensure that all lawful instructions and /or directions given by the Police are complied with.
An incident book shall be kept on the premises by the Designated Premises Supervisor recording every incident of crime and disorder involving the premises, staff, customers or door supervisors.
The Incident book shall contain the following details;
1. Time, date and location of incident.
2. Nature of the incident
3. Names, addresses and contact details of persons involved.
4. Result of the incident
5. Action taken to prevent further such incidents.
6. Each entry signed by the Designated Premises Supervisor or other responsible person employed at the premises and so authorised by the Designated Premises Supervisor.
7. A relevant incident number obtained from the appropriate emergency service.
The Incident Book shall be made available on demand for Local Licensing Officers or Lincolnshire Police Officers.
Each incident book shall be retained for a period of 24 months.
There shall be in place for the premises a written policy to prevent the sale or supply of alcohol to persons under 18 years of age. That policy shall require any person who appears to be under the age of 18 years to produce one of the following forms of identification:
1. A recognised proof of age card accredited under the British Retail Consortiums Proof of Age Standards Scheme (PASS)
2. Photo driving licence
3. Passport
4. Citizen card supported by the Home Office
5. Portman Prove It card
6. Any other means approved and accredited by Lincoln Police Licensing Office.
All point of sale staff shall undergo training in the above-mentioned written policy with a record kept of the date of training, signed by the member of staff and the trainer.
This record shall be made available for inspection by Lincolnshire Police Officers or other parties acting on their behalf.
A notice or notices shall be displayed in and at the entrance to the premises where they can be clearly seen and read and shall indicate;
1. That it is unlawful for persons under 18 to purchase alcohol or for any person to purchase alcohol on behalf of a person under 18 years of age.
2. That proof of age may be requested at the premises The accepted means for proof of age will be listed on the notice(s)
A Refusal Register shall be maintained on the premises containing such information as may be required by Lincolnshire Police, and shall be available for inspection at all times.
The Register shall be in bound pages format with each page consecutively numbered.
Each entry shall be dated and signed by the staff member making the refusal.
Any CCTV evidence to be cross-referenced to the specific refusal.
Description or name of customer to be recorded.
Each entry to be dated and signed by Designated Premises Supervisor and/or Manager/Supervisor.
The Register shall be retained for period of 24 months.
The Register to be produced on request of Police Officer or Licensing Officer.
No form of adult entertainment shall take place on the premises. The term is defined as including striptease, nudity, the wearing of see through material, lap dancing, table dancing and pole dancing and entertainment of a similar nature and includes any such activity displayed on DVD’s
Addendum to Licence Conditions imposed after a hearing by the licensing authority:
· The building alterations shown on the plan accompanying the premises licence application must be approved within three calendar months from the date of this decision by either the Local Authority Building Control or an approved inspector in order to ensure Lincolnshire Fire and Rescue are formally consulted on the proposed alterations.
· Any recommendations of Lincolnshire Fire and Rescue must be implemented prior to the opening of the premises for the first time under this premises licence
