ANNEX 3 - CONDITIONS ATTACHED AFTER A HEARING BY THE LICENSING AUTHORITY
1.0
1.1 A tamper resistant CCTV system shall be installed and (or alternately where such a system is already installed) shall be maintained in working order and operated at the premises to the satisfaction of Lincolnshire Police and must be ‘Fit for Purpose’ by complying with the following conditions;
1.2 The system shall be used to record during all hours that the premises are open to the public.
1.3 Where the recording is on a removable medium (i.e. videotape, compact disc, flash card etc.), a secure storage system to store those recording mediums shall be provided.
1.4 The images recorded by the CCTV system shall be retained in unedited form for a period of not less than 28 days and must be endorsed with the accurate relevant time and date.
1.5 The system shall be capable of monitoring and recording satisfactory images from each and every camera continually e.g. Multiplex facility.
1.6 The system must be capable of monitoring and recording entrances and exits, and any areas not easily observed by staff, including access areas to toilet facilities.
1.7 Any outside area used for the consumption of alcohol shall be fully covered by a CCTV to the satisfaction of Lincolnshire Police.
1.8 The recordings shall be provided to officers of Lincolnshire Police on request.
1.9 Officers of the Lincolnshire Police shall be permitted access to the system at any reasonable time.
1.10 Signage shall be clearly displayed informing customers that a CCTV system is in operation and recording on the premises.
1.11 During all hours that the premises are open or licensable activities are permitted, a member of staff will at all times be on the premises and capable of operating the system in its entirety.
2.0
2.1 The front entrance shall be the sole point of entry and exit from the premises, save for access in the event of an emergency. In addition the rear of the premises shall be secured and alarmed, save for access in the event of an emergency.
2.2 Should the premises employ any door supervisors, a record/log book shall be kept on the premises by the Designated Premises Supervisor of every person employed on the premises as a door supervisor.
The record shall contain the following details:-
i. The door supervisor's name;
ii. His/Her Security Industry Authority Licence Number
iii. The time and date he/she commenced and concluded their duty
iv. The door supervisors shall sign each entry
v. The Designated Premises Supervisor or other authorised person shall also endorse each entry as having checked the authenticity of the individual door supervisor.
2.3 That record shall be available for inspection on demand by an Authorised Officer of the Council, the Security Industry Authority or a Police Constable.
2.4 Each entry shall be retained for a period of 24 months from date of completion.
3.0
3.1 There shall be a written drugs policy for the premises, written in conjunction with and to the satisfaction of Lincolnshire Police, a copy of which is to be appended to the Premises Licence for future reference.
3.2 All staff will be trained in respect of this policy.
3.3 A written record shall be kept detailing the following;
a) Name of the member of staff
b) Name of the Trainer
c) Date the Training was completed
d) Staff member and trainer to sign the authenticity of the record.
3.4 Each entry shall be retained for a period of 24 months from date of completion.
3.5 There shall be remedial or refresher training at a time deemed appropriate by the Designated Premises Supervisor.
3.6 The Licensed premises, shall be subject to such testing or screening for illegal substances as requested by Lincolnshire Police Officers or their authorised agents.
4.0
4.1 Notices will be displayed advising customers that searches will be carried out and admission will be refused to customers refusing to be searched. A record shall be kept showing details of anyone refusing to be searched, together with the time and date of the refusal. Such record to be made available for inspection and copying by police upon request.
4.2 If drugs are found during a personal search, or whilst being used within the premises, following a risk assessment of the situation arising from the find, any person found using or in possession of drugs will be detained, if safe and practicable, and the police called.
4.3 Any drugs found, either during a search or otherwise on the premises, will be confiscated and stored in the Drug Amnesty Box, as detailed in Para 4.7, prior to being handed over to the police, which must be done as soon as practicable.
4.4 Any seizures of drugs, weapons, or other property shall be recorded, together with the name and address of the person found with the article. The record shall be made in a diary or bound book, which shall be retained at the premises for at least 2 years, and shall be made available for inspection and copying by the police upon request.
4.5 A bound and sequentially numbered incident book shall be kept to record all instances of disorder, damage and personal injury at the premises. The book to be made available for inspection and copying by the police and other officers of Responsible Authorities upon request, and all such books to be retained at the premises for at least 2 years.
4.6 The toilets at the premises to be checked hourly for drugs use and evidence of supply taking place. A record to be kept of the results of the checks, detailing how and where any illegal substance was found. The record to be retained at the premises and made available for inspection and copying by the police upon request.
4.7 There shall be a Drug Amnesty Box that shall be a metal strong box, which is lockable and securely attached to the floor or wall within easy reach of the main entrance to facilitate ease of depositing items within.
4.8 The Drug Amnesty Box will be constructed so that items may be placed within, without the person coming into contact with the contents of the box.
4.9 The Drug Amnesty Box will have two locks, one deemed the Management Lock and the other the Police lock, the locks and keys to differ.
4.10 Customers entering the premises will be directed to place any items in the Drug Amnesty Box they wish to prior to being in any area where they could be subjected to a search.
4.11 Any article found within the premises or immediately outside and suspected of being a controlled drug or other dangerous article should be placed in the Drug Amnesty Box.
4.12 The Drug Amnesty Box will be opened and emptied with the police upon police request, with reasonable notice.
5.0
5.1 No one under the age of 18 years to be allowed to remain on the premises after 1700 hours or admitted thereafter, apart from relatives of the DPS, who shall be permitted access to and from any living accommodation within the premises.
5.2 The premises to operate a challenge 21 proof of age scheme, whereby any person who appears to be under the age of 21 will be asked to provide ID. Acceptable forms of ID will include a photographic driving licence, passport or pass accredited card. Failure to produce ID will result in a refused sale.
6.0
6.1 There shall be no speakers in the external areas.
